Jenna B asked:

My friends home got broken into and car keys were stolen and with that stole the vehicle. The vehicle only had liability insurance. Now both homeowners and car insurance are telling them that they won’t pay for that loss. Is this correct in any way? The vehicle has a value of $7K. Would obtaining an attorney be helpful?

  1. Thats something you have to contact your Home Owners Insurance about. but if they said they wont cover it. then that’s it. the keys were stolen out of the house, i dont assume the car was in the house, but if “IT WAS IN THE GARAGE” (not yelling)
That could be a different issue since a garage should be a “part of the house”

  2. Damn that sucks that they are being so uptight. I wonder if the way the economy is effects how big companies make their decisions. I mean would they be like this if money wasn’t such an issue??

  3. Policy, read, understand, if not get a lawyer to explain it. Thief of a car is part of the insurance for a car, but if the owner said the keys were in the house, oops, never tell the insurance company anything. If the vehicle was being stored another story. But their fault for telling the insurance company about the keys. And liability only goes in the insurance companies favor. I would pursue the homeowners policy angle, but rad the policy and get a lawyer if it says anything to the effect of proper within the garage being cover in event of break in or thief.

  4. Auto theft policy would pay if he had it. It was your friends decision not to buy auto theft insurance. He’s lost the car. Homeowners insurance only covers contents of dwelling and structure of the building and even then there are exclusions. Flood and earthquake damage are not covered unless there is extra coverage. Same thing for valuables such as jewelry , artwork, coin and stamp collections. For what it’s worth homeowners should pay to replace the key.

  5. Car insurance won’t pay because the vehicle wasn’t insured against theft, only liability (property damage to others). Homeowners insurance won’t pay, because car theft is covered under auto insurance. An attorney cannot compel an insurance company to pay for anything they are not contractually obligated to pay. In this case an attorney will cost money and not provide any benefit.

This is the risk you take when you only carry liability coverage on a vehicle. Your friend is only insured against one type of peril.

  6. The simple answer is NO. Homeowners policies will specifically exclude any vehicle licensed or intended for road use. To get coverage your friend needed to have Comprehensive coverage on their auto insurance policy.

Attorney will only help if there is a question about coverage and they are denying it.

FYI- In UK 18,500 cars were stolen in 2008 after the keys were stolen in a burglary or off robbed the person.

  7. Jenna B, For car insurance the easiest method to get a cheap quote is do a policy comparison. Be sure to choose the same coverage amounts, you can get an accurate quote to compare against others. Use the same city/state, car make and model, mileage and driving history to make sure you get accurate comparison. To get mulitple auto insurance quotes, go to and you can compare the major auto insurance companies.

  8. It won’t cover the car. If he didn’t buy theft coverage on his car, he has no theft coverage for his car.

Homeowners policies specifically exclude coverage for cars. If he wanted his car covered for theft, he would have to buy theft coverage – comprehensive – on an auto insurance policy.

An attorney isn’t going to be able to get you something you didn’t buy. Sorry.
