  1. Ask the attorney who drew up your “sublease”.

    Bottom line – one person, a private individual, can’t “lease” an auto to someone else via private agreement. The way to insure that, is the OWNER of the car buys the policy, and lists the “leasee” as a driver on the policy. I’ve never seen a lease agreement, that allows a “sublease”. I’ve never seen any loan agreements that allow it, either.

    If you don’t own the car, you can’t register the car without a legal lease to you. DMV’s don’t recognize homemade, drawn up leases from individuals. You can’t insure the car, without an “insurable interest”. And the OWNER of the car, if you take off with the car, is SOL as far as coverage goes, as this is a “voluntary parting”.

    This deal is a really bad idea, from both points of view – both sides have more to lose, than to gain.

    If the owner doesn’t make their payments, even if you make your payments, that car is going to be reposessed. Worse, if they don’t own the car, and it’s called in stolen, YOU can be arrested.

    If the new lessee doesn’t pay the insurance, and causes an accident, that owner is going to have to write a check for all damages.

    I can’t see how this makes sense.

    But to find a cheap price you should get several quotes, do some legwork till something better will come along.
