My lawyer recently sent a demand letter to Lyft’s insurer against their UIM coverage. The accident happened in Florida on March 18, 2020. The liable party had 10k in bodily injury coverage and USAA paid it out in full.

Hello JZ helps, I got in a car accident as a passenger in a Lyft on June 27th, 2020, in Gainesville, Florida. My driver was not wearing a mask that displayed clear violations against the recent health requirements listed on Lyft's website to require drivers to wear a mask but also, his reckless driving led us into the accident. My Lyft driver was on a phone call while driving, made a left turn while ignoring oncoming cars on a straight-way which led to the accident. I was driving lyft and accepted a ride request when I was rear ended and had to have cervical disc surgery. The negligent driver insurance paid $100k. My lawyer wanted to seek additional amount through Lyft. Lyft policy has only $50k in under insured motorist coverage. My case was worth more than $100k that negligent driver insurance paid out. Why does Lyft insurance not cover anything?

Would I still have to pay a $2500 deductible if there was no damage to the other person's vehicle? We both decided there was no damage. She asked for my Insurance Info and I said if so, I'm calling the Cops. She said no need, and asked for my phone number in case she had any questions. She then later filed a Claim with Lyft. I have my passenger's phone# to prove no damage and took pics that I uploaded to Lyft and I was back on the road within minutes.
